Paradocs Healthcare Pvt. Ltd., on behalf of itself and its affiliates/group companies owning the brand "ReOpine," is the author and publisher of the internet resource www.reopine.com, www.reopine.in, and the mobile application 'ReOpine' (together, "Website").
Welcome to ReOpine, an application designed to facilitate scheduling appointments and consultations with super-specialty doctors for second opinions. By accessing or using the ReOpine website or mobile application (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). These Terms form a legally binding agreement between you ("User," "you," or "your") and ReOpine ("we," "us," or "our"), a company located in India. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy (available at https://reopine.com/privacy-policy/), incorporated herein by reference. We may modify these Terms at any time, and such changes will be effective upon posting on the website. Your continued use of the Service after modifications signifies your acceptance of the updated Terms.
This Agreement is published in compliance with, and is governed by the provisions of Indian law, including but not limited to:
- The Indian Contract Act, 1872;
- The Information Technology Act, 2000;
- The Digital Personal Data Protection Act, 2023 ("DPDP Act");
- National Medical Commission Telemedicine Practice Guidelines ("TPG");
- The Consumer Protection Act, 2019;
- The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 ("SPI Rules");
- The Information Technology (Intermediary Guidelines and Digital Ethics Code) Rules, 2021 ("IG Rules").
2. Eligibility
To use the Service, you must:
- Be at least 18 years old, or have parental/guardian consent if aged 13-18. Users under 13 are prohibited from using the Service.
- Provide accurate, current, and complete information during registration and consultation scheduling.
- Be legally capable of entering into binding agreements under Indian law.
3. Purpose and Nature of the Service
ReOpine is a platform that connects Users with independent, licensed specialty/super specialty doctors ("Doctors") for second or first-opinion consultations ("Consults").
- No Medical Advice: ReOpine facilitates scheduling and communication but does not provide medical advice, diagnoses, or treatments itself. No doctor-patient relationship is established with ReOpine.
- Service Modifications: Services may change from time to time at ReOpine's sole discretion.
4. Consultations ("Consults")
- Definition: A "Consult" is a scheduled interaction (via video/phone or in-person, as specified during booking) with a Doctor for medical opinion.
- Scheduling: Bookings are subject to Doctor availability.

- Format: Consults may be virtual or in-person. For virtual Consults, Users are responsible for ensuring sufficient internet and compatible devices.
- Third-Party Services: Consultations may use third-party platforms (e.g., WhatsApp, Google Meet). ReOpine ensures such integrations meet technical and data protection standards but will not be liable for technical failures beyond its control.
- Technical Standards: Integrated third-party services must comply with ReOpine's data protection and interoperability requirements.
- Cancellation/Refunds: Generally, the confirmed bookings are non-refundable. For details, please refer 'Cancellation & Refund policy' available at https://reopine.com/cancellation-refund/
- Receipts: All payment transactions will generate a receipt.
5. User Responsibilities
You agree to:
- Use the Service lawfully and responsibly for seeking medical opinions.
- Provide accurate medical history/documents.
- Consult your primary healthcare provider before acting on any second opinion.
- Not use the Service for emergency situations. Seek immediate in-person care as needed.
- Secure your account credentials.
- Share images/videos only as required through secure Service channels.
- Participate in patient identification verification as per TPG and NMC guidelines.
- Cooperate with ReOpine and provide feedback if requested for service quality improvement.
6. Doctor Interactions
- Doctors are independent practitioners, not employees or agents of ReOpine.
- All Doctors are required to hold valid NMC/state medical council registrations. Credentials are verified periodically.
- ReOpine is responsible for verifying credentials at onboarding and periodically thereafter.
- ReOpine is not liable for the opinions or outcome of consultations, provided due diligence in Doctor vetting and adherence to TPG/NMC is shown.
- Consultations may be limited by the information provided; physical examination or diagnostic tests may be required beyond teleconsultation.
7. Fees and Payments
- Fees are disclosed before booking; payment via authorized third-party gateways.
- Fees are non-refundable except as outlined in 'Cancellation & refund policy', which is available at https://reopine.com/cancellation-refund/.
- Bill/receipt provided for each transaction; constitutes proof of service.
- For payment disputes, contact support@reopine.com.
- ReOpine shall not be liable for failures due to user error or third-party gateway/bank issues.
8. Data Privacy and Security
- Applicable Law: ReOpine complies with DPDP Act, SPI Rules, and other relevant Indian data protection laws.
- Consent & Rights: User consent is obtained before collecting, processing, or storing personal/sensitive data.
- Users have the right to access, correct, and erase their personal data; requests may be made to support@reopine.com.
- Data is kept only as long as required by law or contractual necessity, after which it is securely deleted.
- Data localization: Sensitive health data may be stored in servers within India as required by regulation.
- Breach Notification: In case of data breach, affected users and regulatory authorities will be notified within mandated timelines.
- Encryption and robust security measures are adopted. Third-party vendors must comply with equivalent data protection standards.

- Grievance Officer: ReOpine has appointed a Grievance Officer (see Section 15) for data protection and other complaints.
9. Intellectual Property
- The Service, all content, design, branding, and user-generated content uploaded for Consults, are protected under Indian IP law and remain owned by ReOpine and/or respective licensors.
- Users retain ownership of their medical records/data but grant limited rights for the purpose of consultation and platform improvement.
- Reverse engineering, unauthorized copying/modification/distribution, or competitive misuse is strictly prohibited.
10. Limitation of Liability
- The Service is provided "as is" without warranties of uninterrupted access, error-free operation, or specific results from Consults.
- ReOpine's total liability for any claim under these Terms shall be limited to the amount of Fees paid by the User for the disputed transaction under the particular claim, and in no event to more than INR 10,000.
- These limitations do not apply to liability for fraud, wilful misconduct, or regulatory violations.
- Medical negligence/breach by doctors shall be investigated as per legal provisioning in India; ReOpine will cooperate with authorities.
11. Disclaimers
- ReOpine's services do not replace in-person medical care.
- These services are not for Emergency/ SOS use. For emergencies, diagnoses, or treatment, consult a local healthcare provider/ hospital.
- Opinions provided by Doctors via the Service reflect their own professional judgment. ReOpine does not guarantee their accuracy/applicability.
- Doctors are licensed to practice in India; users outside India must ensure eligibility for cross-border consultations.
12. Emergency Consultation Protocol
- ReOpine is NOT intended for emergency medical situations.
- For Emergency situation please contact local healthcare authority/service provider (e.g., By calling '911' in USA & '108' in India)
13. Termination
- ReOpine may suspend/terminate access for breaches of these Terms, suspected illegal activity, or operational necessity.
- Users may delete their accounts by contacting support@reopine.com. Termination does not affect accrued obligations.
14. Grievance Redressal Mechanism
- A dedicated Grievance Officer is appointed, with contact details below.
- Complaints must be acknowledged within 24 hours, resolved within 15 business days as per IT Rules.
- If unresolved, escalation to regulatory authorities is available.
15. Governing Law and Jurisdiction
- These Terms and any disputes are governed by the laws of India.
- Disputes subject to exclusive jurisdiction of the courts at Ahmedabad, Gujarat, India.
16. Dispute Resolution
- Disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 (unless prohibited by law).
- Class action waivers apply to users of the platform.
17. Force Majeure
- ReOpine is not liable for delays or failures due to events beyond reasonable control (e.g., natural disasters, pandemics, regulatory changes).

19. Miscellaneous
- Severability: If any provision is unenforceable, remaining Terms remain effective.
- Entire Agreement: These Terms, the Privacy Policy, and any additional agreements constitute the entire agreement, superseding prior communications.
20. Cross-Border Use of Services
Reopine and its affiliated Doctors are licensed to practice medicine only within India under the authority of the National Medical Commission (NMC) and respective State Medical Councils.
If a User accesses the Service from outside India:
- The User acknowledges that the consultation is being rendered from India, under Indian law, and shall be deemed to have taken place in India.
- The User agrees that it is his/her/their sole responsibility to ensure compliance with the laws and regulations of the jurisdiction where he/she/they is/are located.
- Reopine does not guarantee that use of its Services outside India is permitted or lawful. By continuing, the User accepts all risks and consequences of cross-border use.
- Any dispute arising out of such consultation shall be governed exclusively by the laws of India, subject to jurisdiction of the competent courts at Ahmedabad, Gujarat, India, irrespective of the User's location.
